Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the HirePersonalTrainer platform (the “Service”) operated by InfiniSearches Pty Ltd (ABN: 88 694 044 249) (“we”, “us”, “our”). By accessing or using the Service, you agree to these Terms.
1. The Service
HirePersonalTrainer provides a platform to help users discover and connect with fitness trainers and related service providers. We do not provide training services ourselves and we are not a party to agreements between users and trainers.
2. Eligibility and Accounts
- You must provide accurate information and keep your account details up to date.
- You are responsible for maintaining the confidentiality of your credentials and all activity on your account.
- We may suspend or terminate access if we reasonably believe you have breached these Terms.
3. User Content
You are responsible for the content you submit, including profile information, photos, and messages (“User Content”). You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display your User Content for the purpose of operating and improving the Service.
4. Subscriptions, Billing, and Cancellation
Some features require a paid subscription. Pricing, billing frequency, and included features are shown at checkout. Subscriptions renew automatically unless cancelled. Where presented on the plan grid, “Cancel anytime without fee” refers to our cancellation processing fee (we do not charge a cancellation fee); your payment provider may have its own policies.
We may change pricing or plan features over time, but changes will not apply retroactively to a completed billing period. If you cancel, access to subscription features may continue until the end of the current billing period.
5. Acceptable Use
- Do not use the Service for unlawful, harmful, abusive, or misleading purposes.
- Do not attempt to interfere with or disrupt the Service, including by scraping or automated access.
- Do not impersonate others or misrepresent your identity, qualifications, or location.
6. Disclaimers
The Service is provided “as is” and “as available”. We do not guarantee that the Service will be uninterrupted, error-free, or that profiles or listings are accurate, complete, or suitable for your needs. Fitness activities carry inherent risks. You are responsible for assessing suitability, qualifications, and safety before engaging any trainer.
7. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our aggregate liability arising out of or in connection with the Service is limited to the amount paid by you to us for the Service in the 3 months preceding the event giving rise to the claim (or AUD $50 if you have not paid us).
8. Indemnity
You agree to indemnify and hold us harmless from claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service or your breach of these Terms.
9. Changes to These Terms
We may update these Terms from time to time. We will update the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
